1. Scope

This Acceptable Use Policy ("AUP") governs how you may use www.visionwingsmarketing.com, any account you hold with us, and any service, system or platform we operate or manage on your behalf. It forms part of our [Terms of Service](/terms), and the definitions there apply here.

The AUP exists for two reasons: to keep our systems safe, and to keep our clients' campaigns compliant with Indian law and with the policies of the platforms we work on. A breach on your side can result in your ad account being permanently banned.

2. General Standard

You must use the Website and Services lawfully, honestly, and in a way that does not harm us, other users, or third parties.

3. Prohibited Conduct — Website and Accounts

You must not:

  • Use the Website for any unlawful purpose or in breach of any Indian law, including the Information Technology Act, 2000 and the Bharatiya Nyaya Sanhita, 2023;
  • Attempt to gain unauthorised access to any part of the Website, server, database or account, or probe, scan or test for vulnerabilities without our written permission;
  • Introduce viruses, trojans, worms, ransomware, or any other malicious code;
  • Conduct denial-of-service attacks, or place unreasonable load on our infrastructure;
  • Scrape, crawl, harvest or systematically extract content or data using automated means;
  • Use our content, imagery or text to train or fine-tune machine learning or generative AI models;
  • Reverse engineer, decompile or attempt to derive the source code of any system we operate;
  • Share, sell or transfer your account credentials, or use another person's account;
  • Impersonate any person or entity, or misrepresent your affiliation with one;
  • Submit false, misleading or fraudulent information through any form;
  • Circumvent authentication, rate limiting, paywalls or access controls;
  • Use the Website to send spam, chain messages or bulk unsolicited communication.

4. Prohibited Content

You must not submit, upload, publish, or ask us to create, host or distribute content that:

  • Is defamatory, obscene, harassing, threatening, or invasive of privacy;
  • Constitutes hate speech, or promotes enmity between groups on grounds of religion, race, caste, place of birth, language or community;
  • Sexually exploits or endangers children in any way, or is sexually explicit;
  • Incites violence, terrorism, or any criminal act;
  • Infringes any copyright, trademark, patent, trade secret or other proprietary right;
  • Discloses another person's personal data without lawful basis or consent;
  • Contains malware or links to malicious destinations;
  • Is deliberately false and intended to mislead, including deepfakes or synthetic media misrepresenting a real person;
  • Is otherwise unlawful under Indian law or prohibited under Rule 3(1)(b) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

5. Marketing-Specific Restrictions

Because we execute campaigns on your behalf, the following apply to work you commission from us. We will decline or halt any campaign that requires these practices.

Advertising claims. No misleading, exaggerated or unsubstantiated claims. Claims about performance, results, ingredients, qualifications, earnings or medical benefits must be substantiated on request, as required by the Consumer Protection Act, 2019 and the CCPA Guidelines for Prevention of Misleading Advertisements and Endorsements, 2022. Comparative advertising must be truthful and verifiable. Testimonials must be genuine, from real customers, and reflect honest experience. Paid endorsements must be disclosed.

Regulated sectors. Advertising for pharmaceuticals, health and wellness claims, financial products, real estate, education, alcohol, tobacco, gambling, betting and online real-money gaming is subject to sector-specific restrictions and, in several cases, statutory prohibitions. We will only proceed where the campaign demonstrably complies, and we may require written confirmation of licences or regulatory approvals.

SEO practices. We do not engage in cloaking, doorway pages, hidden text, paid link schemes, private blog networks, content scraping, negative SEO against competitors, or fake or incentivised reviews. We do not buy, sell, solicit or fabricate Google reviews, and we will not manipulate ratings on any platform. Requests to do so will be refused.

Email, SMS and WhatsApp marketing. All bulk communication must go to recipients who have given verifiable consent. You warrant that any contact list you supply was lawfully collected, is not purchased or scraped, and carries valid consent. Every message must identify the sender and offer a working opt-out. WhatsApp Business messaging must comply with WhatsApp's Business and Commerce Policies. Telemarketing must comply with TRAI's Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018, including DLT registration and respect for the Do Not Disturb registry.

Social media. No purchase of followers, likes, views or engagement; no bot networks; no coordinated inauthentic behaviour; no hijacking of unrelated trending topics; no use of another brand's trademarks in a misleading way.

Data. Customer data you share with us for campaign purposes must have been collected with a lawful basis and consent under the Digital Personal Data Protection Act, 2023, and may only be used for the purposes you have specified.

6. Platform Policies

All work is additionally subject to the policies of the platforms on which it runs, including Google Ads, Google Business Profile, Meta, LinkedIn, YouTube and WhatsApp. Where a platform policy is stricter than this AUP, the platform policy applies. We are not responsible for account restrictions arising from content or claims you insisted upon.

7. Reporting a Violation

To report content or conduct that breaches this AUP, contact our Grievance Officer:

Include the URL or location, a description of the issue, and your contact details. We acknowledge within 24 hours and aim to resolve within 15 days, in line with the timelines under the IT Rules, 2021.

8. Enforcement

Where we identify or are notified of a breach, we may — at our discretion and in proportion to the breach:

  1. Issue a written warning;
  2. Remove or disable access to the offending content;
  3. Pause or terminate an active campaign;
  4. Suspend or terminate your account or engagement, without refund;
  5. Retain evidence and report the matter to law enforcement or the relevant platform, where required by law.

We may act without prior notice where the breach is serious, unlawful, or presents an immediate risk. Termination for breach of this AUP does not entitle you to a refund, and outstanding fees remain payable.

9. Changes

We may update this AUP as law, platform rules and threats evolve. The current version is always the one published on the Website.
